Survival Masters offers this website, including all information, products, tools and services available on it, subject to your acceptance of all terms, policies and notices stated here.

By visiting our website and/or buying something from us, you use our service and agree to these Terms and Conditions. They apply to all website users, including visitors, customers, merchants and other users.

Please read these Terms and Conditions carefully before accessing or using our website. If you do not agree to all the terms of this agreement, you may not use the website or purchase products through our shop.

Any new features, products or tools added to the current shop are also subject to these Terms and Conditions. You can review their latest version on this page at any time.

We reserve the right to update, change or replace parts of these Terms and Conditions by posting updates and/or changes on our website. You are responsible for checking this page regularly for changes. Your continued use of or access to the website after changes are posted constitutes acceptance of those changes.

Our shop operates on Shopify, which provides the online e-commerce platform that enables us to sell our products to you.

Section 2 – Online shop terms

You may not use our products for illegal or unauthorised purposes. When using the shop, you must not violate applicable laws, particularly copyright, trademark, competition or consumer protection laws.

You must not transmit viruses, malware or other code that could impair the operation of the website or shop.

A breach of these terms may result in immediate termination or restriction of access to our service.

Section 3 – General conditions

We reserve the right to refuse orders or use of our service for legitimate reasons.

You understand that your content, excluding payment information, may be transferred unencrypted across various networks and adapted to the technical requirements of connecting networks or devices. Payment information is generally encrypted during transmission.

You agree not to copy, reproduce, sell, resell or commercially exploit any part of the shop, website, service or content without our express written permission.

The headings in these Terms and Conditions are for convenience only and do not affect their interpretation.

Section 4 – Products and product presentation

We primarily sell e-scooter skins, sticker kits, decorative films and accessories for e-scooters.

We endeavour to display product images, colours, designs and descriptions as accurately as possible. Nevertheless, colours may vary slightly depending on the screen, display settings, print batch, film material or lighting conditions.

Some images of fitted skins are for illustration. The exact items included are specified in the relevant product description.

All product descriptions, prices and availability may change at any time. We reserve the right to change, replace or discontinue products at any time.

Section 5 – Custom products and individual designs

Where we offer individual, personalised or made-to-order products, these are manufactured specifically to customer specifications.

Returns or withdrawal are excluded for individually made or personalised products to the extent permitted by law. This includes personalised scooter skins, custom designs, special orders, films individually produced to customer requirements, and products featuring customer-specific names, logos, colours or motifs.

Customers are responsible for ensuring that logos, motifs, names, brands, graphics or other content they provide do not infringe third-party rights, particularly copyright, trademark, design and personality rights.

We reserve the right to refuse orders where we suspect infringement of third-party rights, or where content is unlawful, offensive, discriminatory or otherwise impermissible.

Section 6 – Prices and payment terms

All prices are displayed in the shop and, unless otherwise stated, include applicable statutory VAT.

Additional shipping charges may apply. These are displayed at checkout before you place a binding order.

We primarily use Shopify Payments and PayPal to process payments. Depending on the payment method, the respective payment provider’s terms and privacy notices also apply.

We reserve the right to change prices at any time. Orders already placed are subject to the price displayed at the time of ordering.

Section 7 – Orders and formation of the contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By clicking the order button, you submit a binding offer to purchase the products in your cart.

After receiving your order, we will send an order confirmation by email. The contract is concluded when we accept your order, dispatch the goods or confirm dispatch by email.

We reserve the right to refuse or cancel orders, particularly if a product is unavailable, payment problems occur, information is incomplete or incorrect, there is suspicion of misuse, fraud or infringement of rights, or the customer breaches these Terms and Conditions.

If we cancel an order, we will refund payments already made unless a legal or contractual reason prevents this.

Section 8 – Accuracy of billing and account information

You agree to provide current, complete and accurate information when ordering, particularly your name, billing address, delivery address, email address and payment information.

You are responsible for promptly updating your information when it changes so that we can process your order and contact you if necessary.

We accept no responsibility for delays or misdeliveries resulting from incorrect or incomplete information provided by the customer.

Section 9 – Shipping and delivery

We ship with DHL, DPD and Hermes. Available shipping methods and costs are displayed at checkout.

Delivery times may vary depending on the product, availability, production requirements, carrier and destination country. Unless expressly stated otherwise, delivery times are non-binding estimates.

For personalised or individually made products, production starts only once all necessary details have been clarified and payment has been received.

For consumers, the risk of accidental loss or deterioration of the goods passes only when the goods are handed over to the customer or an authorised recipient.

Section 10 – Returns, withdrawal and refunds

Please note that film which has already been applied, used, damaged or soiled cannot be returned.

The right of withdrawal may be excluded by law for individually made or personalised products.

Section 11 – Inspection on receipt, damage and complaints

Please inspect your order immediately on receipt.

If the item is defective, damaged or incorrectly supplied, please contact us as soon as possible at Survivalmasterskontakt@gmail.com.

Where possible, please send photos of the damaged or incorrect item together with your order number so that we can review the matter promptly.

Section 12 – Fitting and using the products

Our scooter skins and films must be applied carefully and in accordance with the instructions.

Customers are responsible for thoroughly cleaning and degreasing the e-scooter before application and applying the film correctly.

We accept no liability for damage or unsatisfactory results caused by improper fitting, incorrect cleaning, unsuitable surfaces, heavy soiling, unsuitable temperatures, moisture, mechanical damage or improper use.

Any instructional video or fitting guide provided is intended as assistance. We do not guarantee a perfect fitting result by the customer.

Section 13 – Durability and use

The durability of our films depends on various factors, particularly film material, printing process, weather, UV exposure, cleaning, mechanical stress, the underlying surface, fitting quality and use of the e-scooter.

Durability information provides guidance and does not guarantee a specific service life.

E-scooters are everyday-use products. Scratches, abrasion, dirt, stone chips, contact with shoes and weather can damage the film or shorten its service life.

Section 14 – Copyright, trademarks and intellectual property

All content on this website, particularly texts, product images, designs, graphics, logos, product names and layouts, is protected by copyright, trademark or other rights unless expressly identified otherwise.

Using, reproducing, modifying, distributing or commercially exploiting our content without express written consent is prohibited.

Customers submitting their own files, logos or designs confirm that they are entitled to use this content and that it does not infringe third-party rights.

The customer indemnifies us against all third-party claims arising from the use of content provided by the customer.

Section 15 – Prohibited uses

In addition to other prohibitions in these Terms and Conditions, you may not use the website or its content for unlawful purposes; to infringe copyright, trademark or other third-party rights; to submit false or misleading information; to distribute viruses, malware or other harmful code; for spamming, phishing, scraping, crawling or similar activities; to harass, insult, discriminate against or harm others; or to circumvent security features of the website or shop.

We reserve the right to refuse orders or terminate access to our service where prohibited use occurs or is suspected.

Our website may contain links to third-party websites that are not under our control.

We are not responsible for third-party content, privacy practices, products or services. Use of third-party websites is at your own risk.

In particular, we are not liable for damage caused by improper application, fitting errors, unsuitable surfaces, normal wear, external influences or use of the products other than for their intended purpose.

We reserve the right to change, supplement or discontinue products, prices, content or the service at any time.

Price changes do not apply retrospectively to orders already placed.

If a provision of these Terms and Conditions is or becomes invalid or unenforceable, the remaining provisions remain effective.

The statutory provisions apply in place of the invalid provision.

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

Mandatory statutory consumer protection provisions of the country in which the consumer habitually resides remain unaffected.
