Dudenhofen: Scooter with retrofitted seat seized

Dudenhofen, October 4, 2026: Following an e-scooter inspection, the police have seized a vehicle equipped with a retrofitted seat and lacking insurance plates. In addition to investigations regarding intoxication, the case centers on an important question: Does a modified scooter still correspond to its approved vehicle type?
What the police are reporting
The Ludwigshafen Police Department reported an inspection on October 3 at approximately 10:00 a.m. on Maxburgstraße. Two riders, aged 37 and 39, were involved. Officers noted signs of alcohol and narcotics, ordered blood samples, and initiated criminal proceedings for suspected driving under the influence.
One of the vehicles was missing its insurance plate; additionally, a seat had been installed. The police seized this scooter. In their preliminary assessment, the modified vehicle might be classified as a moped rather than a small electric vehicle. No final expert report or outcome of the proceedings has been published in the statement.
Why the seat is legally relevant
Section 1 of the eKFV (Ordinance on Small Electric Vehicles) explicitly defines small electric vehicles as those without a seat or self-balancing vehicles with or without a seat. The exemption for self-balancing vehicles should therefore not be read as general permission for a retrofitted seat on a standard kick scooter. A blanket statement that every electric scooter with a seat is automatically a moped would be equally overly broad.
Additionally, Section 19 (2) of the StVZO (Road Traffic Licensing Regulations) is relevant: A modification that alters the approved vehicle type can result in the voiding of the operating permit. The regulation also covers other cases of modification and exceptions for approved attachments. Whether a specific conversion is permissible therefore depends on the vehicle and documentation, not solely on whether the accessory can be technically bolted on.
What owners should check before a conversion
Our practical recommendation: Before purchasing a seat, have the documentation for your vehicle and the attachment checked together. A shop description or a matching mounting point does not answer the registration question. It is advisable to obtain written information from the manufacturer or a professional assessment that refers to the exact model and the specific attachment. Without a clarified status, the converted vehicle should not be used in public traffic.
The vehicle class also determines which requirements apply thereafter. The term "moped" in a preliminary police report does not replace a complete review of the operating permit, insurance, and required personal documentation. No specific penalty can be derived from the seizure alone. Technical classification and separate intoxication investigations should be kept distinct.
The further regulatory framework is covered in our E-scooter rule check; current and future regulations are separated there. The significance of alcohol rules is contextualized in the Frankfurt inspection report.
